The mission of the NOCs is to develop, promote and protect the Olympic Movement in their respective countries, in accordance with the Olympic Charter and in its role is included that it has to ensure the observance of the Olympic Charter in their respective countries. The Olympic Charter states explicitly that any person or organisation belonging in any capacity whatsoever to the Olympic Movement is bound by the provisions of the Olympic Charter and shall abide by the decisions of the IOC. The Olympic Charter defines the main reciprocal rights and obligation of the three main constituents of the Olympic Movement, namely the International Olympic Committee, the International Federations and the National Olympic Committees, all of which are required to comply with the Olympic Charter and protect the Olympic Movement. Belonging to the Olympic Movement requires compliance with the Olympic Charter and recognition by the IOC. Under the supreme authority and leadership of the International Olympic Committee, the Olympic Movement encompasses organisations, athletes and other persons who agree to be guided by the Olympic Charter and who must comply with the Olympic Charter. As far as the affiliated bodies are concerned the Charter states that to be recognised by an NOC and accepted as a member of such NOC, a national federation must exercise, real and on-going sports activity, be affiliated to an IF recognised by the IOC and be governed by and comply in all aspects with both the Olympic Charter and the rules of its IFs.

In the present scenario, not only has the Olympic Charter been violated, but also the Constitution of POA and the Constitution of IOA itself. The President POA under the existing regulatory provisions of the Constitution of POA namely Article IV (16), IV (20), IX (4)(a) and through the powers given to him by the General Council and Executive Committee of POA in the meetings of 12 February, 2011 and 1st July, 2012 respectively, has temporarily debarred the President Islamabad Olympic Association (IOA) to act as such on the grounds as highlighted in the attached letter. He would be given an opportunity to present his case before any final or firm decision is taken.

Where the said letter has been directly  written to him debarring him temporarily from being in any manner associated with any sports association or organization, directly or indirectly, or holding any office in any organization which is otherwise affiliated, a letter has also been written to the Secretary, IOA to confirm within 24 hours whether :-

a.      the IOA Constitution permits its President or any office bearer to file proceedings against the IOA which do not pertain to a personal right arising out of the Constitution of the IOA?;

b.      the IOA consented to the institution of this Writ Petition and whether the President of the IOA informed or sought permission of the IOA’s General Body to institute such proceedings, albeit in his personal name while clearly referencing and representing himself as the President of the IOA in the said Writ Petition?;

c.      the IOA accepts the contents and statements made in this Writ Petition by the President IOA and specifically in terms of requiring the enforcement of the Sports Policy in terms of restriction of tenures of office bearers of federations and associations?
